The US Court of Appeals for the 9th Circuit ruled that a California federal judge was right to toss crypto-focused law firm Hodl Law PLLC’s preemptive challenge to the SEC, since the firm failed to show it faced any “realistic danger” of catching an enforcement case over its use of ETH. The firm had sought a judgment that its use of the ethereum network and ETH does not offend securities laws, but Circuit Judges Kim McLane Wardlaw, Richard Paez, and Gabriel Sanchez ruled that Hodl Law PLLC failed to allege a case or controversy with the SEC that the court could oversee.
